The products purchased on the Website are offered and sold by Egeria società agricola Srl , registered office at Piaz-za Duca d’Aosta, 12, Milan, share capital 165,000.00 euro i.v., CF/P.IVA IT10220830961, Cam.Com MI – 2514315, (hereinafter referred to as EGERIA)
- SCOPE OF APPLICATION
1.1 The General Terms and Conditions of Sale may be amended at any time. Any amendments and/or new conditions will be in force from the time of their publication on the Website. For this reason, users are invited to regularly access the Website and consult the most updated version of the General Terms and Conditions of Sale before making any purchase. The applicable General Terms and Conditions of Sale are those in force on the date the purchase order is sent.
- PURCHASES ON THE SITE
2.1 With reference to Italian citizens, sales on the Site are reserved only to those aged 18 years or over.
In any case, the user who makes purchases on the Website undertakes to hold EGERIA harmless from any liability in the event that he or she has made purchases on the Website without complying with his or her national law on purchase limits for reasons of age.
Egeria expressly states that it does not wish to induce anyone to act in conflict with the law. All persons who purchase cannabis seeds are responsible for their actions and future actions. All information on the website is for educational purposes only, and is not intended to condone, promote, or incite the cultivation of illegal and/or controlled substances.”.
- SITE REGISTRATION
3.1 The purchase of Products on the Site is permitted only to registered users at the time of purchase.
- INFORMATION DIRECTED TO THE CONCLUSION OF THE CONTRACT
4.1 In accordance with Legislative Decree No. 70 of 9 April 2003, containing provisions on electronic commerce, EGERIA. informs the user that
In order to conclude the contract for the purchase of one or more Products on the Website, the user must fill in an order form in electronic format and send it to EGERIA, electronically, following the instructions that will appear from time to time on the Website and which will accompany the different stages of the purchase;
the contract is concluded when the order form reaches the EGERIA server;
once the order form has been registered, EGERIA. will send the user, via e-mail to the e-mail address indicated, an order confirmation, containing information relating to the characteristics of the Product purchased, a detailed indication of the price, the means of payment used, the delivery costs and any additional costs, as well as the Customer Service contact details, which the user may contact to request assistance and/or submit complaints. It is recommended to keep the e-mail received as proof of purchase. The General Terms and Conditions of Sale and information on the right of withdrawal, as well as EGERIA’s Privacy Policy, will be available on the pages of the website.
The order form will be stored in EGERIA’s database for the time required to process the order and, in any case, within the terms of the law. In order to access his order form, the user may consult his account.
- VALIDITY OF OFFERS AND PRICES
5.1 All prices of the Products are quoted in Euros (€) and are inclusive of Value Added Tax (“VAT”), unless otherwise stated. Any additional costs shall be expressly and separately indicated in the order form, before the user proceeds to submit it.
5.2 The price of the Products may be changed by EGERIA at any time, without prior notice, it being understood that the price charged to the user will be the one published on the information sheet illustrating the main characteristics of the Product (Product Sheet) at the time the order is sent. Any variations (upwards or downwards) in price following the transmission of the order will not be taken into account.
- PURCHASE ORDERS – PRODUCT INFORMATION
6.1 The prices, descriptions or availability of the products displayed are subject to change without notice. Should an ordered item be unavailable, the Holder shall inform the customer immediately and proceed to refund any price already paid.
6.2 EGERIA will process the purchase order, and then ship the purchased Product, only after receiving confirmation of the authorization to pay the total amount due, consisting of the purchase price, the delivery charges, if any, and any other additional cost, as indicated in the order form (Total Due Amount). In the event that the Total Due Amount is not paid, or the successful payment is not confirmed, the purchase contract shall be deemed to be rescinded pursuant to and for the purposes of Article 1456 of the Italian Civil Code.
6.3 The Products will remain the property of EGERIA until payment by the user of the Total Amount Due. The risk of loss of or damage to the Products, due to causes not attributable to EGERIA, on the other hand, will be transferred to the user when the user, or a third party designated by the same and other than the carrier, takes physical possession of the Products.
6.4 Each Product is accompanied by a Product Sheet. The images and descriptions present on the Site reproduce the characteristics of the Products as faithfully as possible. Furthermore, the Product images on the Product Sheet may differ in terms of vintage and/or dimensions or in relation to any accessory products. Such images must therefore be understood as indicative and within the tolerances of use. For the purposes of the purchase contract, the description of the Product contained in the order form transmitted by the user shall prevail.
In caso di mancato ritiro entro il termine stabilito dal trasportatore, i prodotti verranno restituiti al Titolare, che rimborserà il prezzo dei prodotti. Il Titolare non può essere ritenuto responsabile per errori nella consegna dovuti a inesattezze o incompletezze nella compilazione dell’ordine d’acquisto da parte dell’Utente, né per ritardi nella spedizione o danni eventualmente occorsi ai prodotti successivamente alla consegna al vettore, ove quest’ultimo sia stato scelto ed incaricato dall’Utente.
- DELIVERY OF PURCHASED PRODUCTS
7.1 Deliveries are made during normal business hours to the address indicated by you, through a carrier throughout Italy. The carrier assumes full responsibility for transport, from pick-up to delivery to the address you have indicated.
- METHODS OF PAYMENT
8.1 Payment for the Products may be made by credit card, by bank transfer payment solution. In the event that one of these means/solutions of payment cannot be used in relation to a specific Product, this will be clearly indicated on the Site, at the latest at the beginning of the purchase procedure.
8.2 Payment by credit or debit card
8.2.1 Payment for Products may be made by credit or debit card directly through the Site.
8.2.2 The confidential credit card data (card number, cardholder, expiry date, security code) are encrypted and transmitted directly to the payment processor without passing through the servers used by EGERIA. EGERIA, therefore, never has access to and does not store the data of the credit card used by the user to pay for the Products (even in the event the user has decided to store the credit card data on the Website), with the exception of the name of the credit card holder.
8.3 Bank transfer
8.3.1 If the user decides to pay by bank transfer, the order shall be shipped as soon as EGERIA has received the crediting of the amount relating to the order.
- RIGHT OF WITHDRAWAL
9.1 The user who purchases EGERIA’s products purchases goods that by their very nature are quickly degradable. Therefore, the user’s Right of Withdrawal is treated according to Article 59 of the Consumer Code “The right of withdrawal referred to in Articles 52 to 58 for distance contracts and contracts negotiated away from business premises is excluded with respect to: …
(d) the supply of goods which are liable to deteriorate or expire rapidly; …”
- MISCELLANEOUS
10.1 EGERIA is a registered trademark. Photos, texts, descriptions and everything contained in the Website are the property of EGERIA. The reproduction in whole or in part of any part of the Website is prohibited; the reproduction of texts or photos for any use whatsoever and in any form whatsoever, and in any event without the prior written authorisation of EGERIA
10.2 EGERIA is not liable for any damages suffered by the user or by third parties or to things owned by the user or by third parties due to delays in delivery or related to the use of the Product.
- LEGAL GUARANTEE OF CONFORMITY
11.1 The User who purchases as a consumer has the right to a guarantee on the products and services purchased within 24 months of purchase and under the conditions established by law, provided that the Holder is notified of the defects found, in the same way as for withdrawal, within 2 months of their discovery.
In order to exercise the warranty right, the User must return the product by following the instructions indicated in the relevant section of the site or, failing that, by contacting the Owner.

The Service is provided by the Owner “as is”, without any express or implied warranty for its accuracy or availability.
- APPLICABLE LAW AND JURISDICTION
12.1 These Terms and all disputes in respect of the performance, interpretation and validity of this agreement shall be subject to the law, the jurisdiction of the State and the exclusive jurisdiction of the court of the place where the Owner is established. An exception is made for the exclusive jurisdiction of the consumer where the law so provides.
